Is an online divorce really cheaper?

Online divorce is more cost-effective because only one lawyer is involved in the proceedings. It is therefore particularly suitable for amicable divorces. In this case, the other spouse can simply agree to the divorce without having to instruct their own lawyer and bear their own legal costs. The spouses can therefore share the costs of just one lawyer

Marriages lasting less than three years, childless marriages and marriages in which no particular assets have accrued during the course of the marriage are often divorced by mutual consent.

Can I get divorced online?

In principle, divorce is subject to two conditions: you must have completed the so-called year of separation and at least one spouse wants to get divorced. Of course, it is a great advantage for an uncomplicated process if both spouses want to get divorced, i.e. if the divorce is by mutual agreement and the consequences of the divorce have already been discussed in advance.

What are the special features of an online divorce?

An online divorce is particularly suitable for consensual divorces and so-called short marriages. If both spouses are in agreement and on good terms, an online divorce can be a practical and cost-effective option. The necessary documents and papers can be processed and submitted from the comfort of your own home, without waiting times and the hassle of constant postage. In addition, an online divorce only requires one lawyer who exclusively represents the applicant.

What does an online divorce cost?

The basis for calculating the costs of divorce proceedings for lawyers and the family court is a procedural value, which is determined on the basis of various factors such as the net income of both partners, assets and loan debts, child maintenance and the implementation of pension equalization. This can quickly add up to several thousand euros. The more agreement between the spouses, the cheaper the divorce will be overall. In our free initial consultation, you will find out immediately what costs you can expect and save.

Additional advantages of amicable divorce?

In a divorce by mutual consent, the process is significantly shorter and the costs of the divorce are considerably lower. In addition to both parties' consent and the one-year separation period, the issues of custody, maintenance obligations towards minor children and the marital home and its household effects must be clarified between the parties in advance.

The stress of divorce can be limited these days.

You can even save money. If things are no longer going well and a divorce is imminent, legal assistance is required. We support you in a trusting partnership to make your separate future uncomplicated. Quick, simple and cost-effective.

In Germany, two essential requirements must be met before a divorce can be filed:

1. period of separation: You must have been separated for at least one year. During this time, the marital relationship must have been dissolved. Separation within the shared home is possible, provided there is a "separation of table and bed".

2. breakdown of the marriage: The marriage must be deemed to have broken down. This is assumed if the spouses are no longer able to continue the marriage and there is no prospect of reconciliation.

The divorce process:

1. application for divorce

The divorce begins with the submission of a divorce petition. You should also send us your marriage certificate, the birth certificates of the children and - if available - your spouse's consent to the divorce, your marriage contract or your divorce settlement agreement, if applicable.

2. Service on the court and spouse:

The application is submitted to the court. Approximately two weeks later, you will receive the invoice for court costs including the file number of your divorce proceedings. Once the court costs have been received, the court will send the divorce petition to your spouse. They can agree to the application, reject it or file their own divorce application with the help of their own lawyer.

3. pension equalization

The so-called pension equalization is then carried out. Both spouses receive forms for this, which you fill in and return to the court. The court then forwards the forms to the pension insurance or pension providers, who provide information about the existing pension provision, i.e. the amount of pension entitlements acquired during the marriage. The court then sets the divorce date.

4. divorce date and divorce decree

The spouses must be present in person at the hearing. It usually only lasts a few minutes. At the end, the divorce decree is pronounced by the judge. After a month has passed without an appeal or complaint being lodged, the divorce decree becomes final. You will receive your divorce certificate.

How long does the divorce process usually take?

In most family courts, divorce proceedings by mutual consent take on average around three to four months from the filing of the divorce petition to the divorce hearing if the so-called pension equalization is waived or has already been settled.

Divorce proceedings with pension equalization take at least seven to ten months. The processing times at the pension insurance institutions and the courts can only be influenced to a limited extent.

<p

How can I get divorced as quickly and cleanly as possible?

You can avoid delays in the divorce if the information on the divorce form is complete and correct and the marriage certificate and the birth certificates of the minor children are available. The divorce petition will only be served on your spouse by the court once the court costs have been received by the court. It is advisable to transfer the court costs to the court at the same time as the divorce petition.</p

It is even quicker if the written consent of your spouse is already enclosed.

Do I need a lawyer? Is a single lawyer enough?

A divorce without a lawyer is not possible in Germany. According to § 114 FamFG, a lawyer is mandatory. This also applies to online divorce. The spouse who files the divorce petition must instruct a lawyer. The lawyer requires a separate power of attorney for this purpose.</p

It can be a very good idea for only one lawyer to be involved in the divorce proceedings if there is agreement on the consequences of the divorce. This saves the costs of appointing both parties. The other spouse then only has to agree if there is agreement between the ex-partners. No separate lawyer is needed for the other spouse.

How long does it take for the online divorce to be completed?

Due to its amicable nature, an online divorce procedure is quicker to process with a divorce service. You can save a few days. As soon as the divorce application is submitted to the court, the wheels of justice start turning. The justice system does what it can, is sometimes completely overloaded and works its way through mountains of files. You should allow between 3-9 months for a divorce by mutual consent. In individual cases it can take a little longer, but it can also be shortened. The quickest divorce in our office was completed after 6 weeks.
