What does the area of data protection refer to?

Privacy refers to the practices, measures and laws designed to ensure the protection of personal data. Personal data is information that relates to an identified or identifiable natural person.

What is personal data?

Personal data is information that relates to a specific person or can be assigned to a person. This includes, among other things, name, signature, date of birth and address data. Photos that show a person are also personal data. The same applies to files that can be assigned to a person in the overall context. There are also special categories, including health data, religion or sexual orientation, which enjoy special protection due to their sensitivity.

The personal reference only applies to people, not to legal entities such as limited liability companies or associations. However, the data of the representatives of a legal entity, such as their name, are personal data and are therefore subject to the GDPR.

What is considered processing?

The term "processing" covers every action involving personal data - from collection, storage and use to disclosure and erasure. This term is therefore very broadly defined.

The rules of the GDPR do not apply to the handling of personal data that is subject to the so-called household privilege. So if you use data for purely private or family purposes, for example if you run a family WhatsApp group, the GDPR does not apply to you.

Can I still use Facebook, Google & Co, even though the servers are located in the USA?

Yes, you may continue to use these services and operate Facebook fan pages or Instagram accounts, for example. Although the Schrems II decision overturned the Privacy Shield, if you successfully weigh up your interests and have a data transfer impact assessment (TIA) and have concluded standard contractual clauses (SCC), you may also transfer data to unsafe third countries such as the USA. However, for a legally sound decision, each individual case must be considered on its own merits.
